Risk & Title

Risk in the Products, including loss, damage, deterioration, evaporation, or any other condition or incidents related thereto shall pass to the Buyer as the Products pass the fixed bunker connections on the delivering vessel or truck. The Buyer warrants that representatives from the Vessel shall be responsible for ensuring that the Products are received in a safe way.
Title in and to the Products delivered and/or property rights in and to such Products shall remain vested in Med Petroleum until payment has been received by Med Petroleum of all amounts due in connection with the respective delivery.
Until full payment of any amounts due to Med Petroleum for whatever nature, has been made, the Buyer shall not be entitled to use the Products other than for the propulsing of the vessel, nor mix, blend, sell, encumber, pledge, alienate, or surrender the Products to any third party.
In case of breach of these Terms and Conditions by the Buyer, Med Petroleum is entitled to take back the Products without prior judicial intervention and without prejudice to all other rights or remedies available to Med Petroleum.
In the event that the Products have been commingled with other products on board the vessel, Med Petroleum shall have the same rights as above to such part of the commingled product as corresponds to the quantity of the Products delivered.
