Claims
- Any dispute as to the quantity delivered must be noted at the time of delivery on the bunker delivery receipt or in a letter of protest. Any claim as to short delivery shall be presented by the Buyer immediately upon completion of delivery, failing which any such claim shall be deemed to be waived and absolutely barred.
- Med Petroleum shall not be liable for claims for short delivery based upon the figures obtained by measuring the Products in the Vessel’s tanks.
- The time limit for receipt by Med Petroleum of a notice of claim in a quantity dispute is 4 days from the date of delivery or such shorter period as may be specified in the Confirmation.
- Claims concerning quality shall have to be submitted to Med Petroleum in writing within 15 days from delivery, failing which the rights to complain or claim compensation of whatever nature shall be deemed to have been waived and absolutely barred for all times. If it is alleged that any equipment or machinery has been damaged by the defective Products, full details must be given to Med Petroleum at the earliest opportunity and the item must be preserved and made available for inspection on demand at any reasonable time or times to Med Petroleum or its representative, otherwise no such claim shall be accepted by Med Petroleum.
- Med Petroleum shall not be responsible for any claim arising in circumstances where there has been commingling of the Products delivered by Med Petroleum with other products aboard the Vessel or the Buyer’s delivery Vessel.
- The Buyer’s submission of any claim does not relieve him from his obligations to make full payments as required under Clause 10 and the Buyer shall not be entitled to set off any claim from payment.
