Liability

To the extent permitted by Law, Med Petroleum shall under no circumstances be liable to the Buyer for any loss or damage including loss of profit or any other consequential loss whatsoever arising from any cause whatsoever whether in contract, tort or otherwise including the negligence of Med Petroleum, its servants, agents or subcontractors.
Notwithstanding the foregoing in the event that Med Petroleum is found to be liable to the Buyer, the total amount payable by way of compensation shall not exceed the value charged to the Buyer for the Products supplied under these Terms and Conditions. It is a precondition to the payment of any compensation by Med Petroleum that all sums standing due to Med Petroleum from the Buyer are first paid and settled.
The Buyer undertakes to indemnify Med Petroleum against any claims, losses or costs of whatever kind related to the supply of the Products instituted by third parties against the Med Petroleum to the extent that such claims exceed Med Petroleum’s liability towards the Buyer according to clause (Liability second paragraph).
